1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and MISKA Tech ("we," "us," or "our"), concerning your access to and use of our website as well as any other media form, media channel, mobile website, or application related, linked, or otherwise connected thereto.

By accessing the site and using our WhatsApp Business API integration services, you agree that you have read, understood, and agreed to be bound by all of these Terms and Conditions. If you do not agree, you must expressly discontinue use immediately.

2. Acceptable Use & Meta Compliance

Because our services rely on the Official Meta WhatsApp Business API, your use of our platform is strictly subject to Meta's Commerce and Business Policies. You agree that:

• You will only send messages to users who have explicitly opted-in to receive communications from your business.
• You will not use the service to transmit spam, unsolicited promotions, or misleading content.
• You will not use the service to sell illegal products, adult content, or any items prohibited by Meta's policy guidelines.
• Violation of these rules may result in the immediate suspension or permanent termination of your WhatsApp Business Account by Meta or MISKA Tech without a refund.

3. Fees and Payment

We offer various subscription tiers (e.g., 3 Month, 6 Month, and 12 Month plans). By selecting a plan, you agree to pay the stated subscription fees.

WhatsApp Cloud Messaging Charges: In addition to our platform subscription fees, standard Meta messaging charges apply (e.g., ₹0.86 for marketing conversations, ₹0.115 for utility conversations). You are responsible for maintaining a sufficient wallet balance or valid payment method to cover these usage-based charges.

4. Intellectual Property Rights

Unless otherwise indicated, the Site and our services are our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us.

5. User Data and Privacy

We care about data privacy and security. By using the Site, you agree to be bound by our Privacy Policy. We do not claim ownership over the contacts, leads, or messages you process through our CRM, but you grant us the right to process this data strictly to provide the requested services.

6. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or API services, even if we have been advised of the possibility of such damages.
